These Terms and Conditions ("Terms") govern your use of Cobia at getcobia.app ("Service") operated by TN App Studio (a product of nventiv LLC) ("we," "us," or "our"). By using Cobia, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

• You must be at least 13 years old to use Cobia
• No account creation is required to browse the site
• If you submit your email address for early access, you represent that you are authorized to do so

2. The Service

Brand Content Intelligence

Cobia analyzes brand-generated social media posts using AI-driven classification across tone and purpose dimensions. Content classification, engagement analysis, and cross-brand comparisons are provided for informational and strategic planning purposes only.

Early Access Program

During the early access period, Cobia may provide content audits and analysis to selected brands. The scope, deliverables, and terms of any early access engagement will be agreed upon separately in writing.

Not Professional Advice

All content on Cobia — including post classifications, engagement scores, tone analysis, purpose categorization, and competitive comparisons — is for informational purposes only and does not constitute marketing, legal, financial, or business advice. We are not a registered marketing agency or professional services firm.

3. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that:

• Content classifications are accurate, complete, or suitable for any particular purpose
• Engagement analysis or recommendations will improve marketing outcomes
• The Service will be uninterrupted or error-free
• Historical patterns in content engagement will repeat in the future

4. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Scrape, crawl, or systematically extract data from the Service without written permission
• Attempt to reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools to access the Service in a manner that disrupts its operation
• Reproduce or redistribute our classifications, analysis, or data for commercial purposes without written permission
• Misrepresent the source of any analysis or content derived from the Service
• Use the Service to transmit spam, malware, or other harmful content

5. Intellectual Property

The Cobia name, logo, tagline ("Brand Content Intelligence"), site design, tone and purpose taxonomy, classification methodology, and all related intellectual property are owned by nventiv LLC and protected by applicable intellectual property laws. You may not use our trademarks or methodology without prior written permission.

6. Third-Party Services

Cobia integrates with third-party services including Cloudflare and Google Fonts. Your use of this site is also subject to their respective terms and privacy policies. We are not responsible for the practices, accuracy, or availability of third-party services.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TN APP STUDIO AND NVENTIV LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO BUSINESS LOSSES, MARKETING LOSSES, OR DAMAGES OF ANY KIND.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED $100.

8. Indemnification

You agree to indemnify and hold harmless TN App Studio and nventiv LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising out of your use of the Service or your violation of these Terms.

9. Termination

• You may stop using the Service at any time
• We may suspend or restrict access to the Service at any time without notice
• Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitations of liability

10. Governing Law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Davidson County, Tennessee.

11. Dispute Resolution

Before filing a formal legal claim, you agree to contact us at legal@tnappstudio.com to attempt to resolve the dispute informally. If we cannot resolve the dispute within 30 days, either party may pursue formal legal action.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be noted on this page with an updated effective date. Your continued use of Cobia after changes take effect constitutes your acceptance of the updated Terms.
